  1. SCOPE OF APPLICATION

The online shop www.natureleafs.com is operated by clean water project UG (limited liability), Gartenstr. 18, 63589 Linsengericht, Germany (hereinafter “NatureLeafs”). The following Terms apply to all orders placed via our online shop.

  1. SERVICES, SPECIALTIES

a. The NatureLeafs online shop offers care and cleaning products as well as general household specialties such as cleaning tabs, body wash, and washing and cleaning agents without plastic packaging or water-soluble PVA film.

b. NatureLeafs strives to depict the offered items as accurately as possible in the online shop. Slight color deviations and other optical differences are, however, possible.

  1. CONCLUSION OF CONTRACT

a. The customer can select the desired specialties from NatureLeafs’ assortment by clicking on them and collect them in the shopping cart via the “Add to Cart” button.

b. The customer can correct any entries made in the shopping cart before submitting the order bindingly, e.g., change the quantity of a specialty, add or remove specialties.

c. By clicking the “Checkout” button, the purchase process continues. Here, the customer can choose either express checkout, log into their user account, or enter the required contact information into the provided fields.

d. In any case, the customer can review and, if necessary, modify the order once more on the overview page “Review Order,” which shows all purchase-relevant information.

e. The purchase contract with NatureLeafs is concluded only by clicking the “Buy” button. A prerequisite for the effective conclusion of the purchase contract is that the customer accepts the Terms in their currently valid version.

f. Immediately after submitting the order, the customer will receive confirmation of the concluded purchase via e-mail.

g. The contract is concluded in German language.

  1. RIGHT OF WITHDRAWAL FOR CONSUMER CONTRACTS

A contract concluded between NatureLeafs and the buyer via www.natureleafs.com is a distance contract within the meaning of § 312c para. 1 BGB. If the buyer is a consumer according to § 13 BGB, he/she has a statutory right of withdrawal according to §§ 312g, 355 BGB.

A consumer within the meaning of § 13 BGB is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional.

Consumers have the following right of withdrawal:

Withdrawal instruction

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (clean water project UG (limited liability), Gartenstr. 18, 63589 Linsengericht, Germany, team@natureleafs.com) by means of a clear statement (e.g., a letter sent by post or e-mail) about your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notification concerning the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day we receive the notification of your withdrawal from this contract. We will use the same means of payment for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this refund.

We may withhold reimbursement until we have received the goods back or you have provided evidence of having sent back the goods, whichever is earlier.

You must send back or hand over the goods without delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You only have to pay for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

  1. DELIVERY TERMS, SHIPPING

a. NatureLeafs delivers only via shipping. Personal pickup of goods is unfortunately not possible.

b. In addition to the indicated specialty prices, shipping costs may be incurred. Shipping costs are specified in the order summary under “Shipping.”

  1. DAMAGE DURING TRANSPORT

If goods are delivered with obvious transport damage, please report such defects immediately to the carrier and contact us without delay. Failure to report or contact us has no consequences for your statutory claims and their enforcement, particularly your warranty rights. However, it helps us assert our own claims against the carrier or transport insurance.

  1. PRICES, PAYMENT

a. The total price of the specialties, including all associated price components, is shown to the customer in the information provided as part of the respective product description.

b. Customers generally have several digital payment options such as credit card, PayPal, and Klarna. The payment options available for the product you selected will be displayed during the order process.

  1. GIFT VOUCHERS

Customers have the option to purchase gift vouchers at NatureLeafs. Gift vouchers are value vouchers that the customer can purchase on natureleafs.com. They can only be redeemed for the purchase of NatureLeafs specialties, but not for the purchase of further gift vouchers. If the balance of a gift voucher is insufficient for the order, the difference can be paid using the offered payment methods. Any remaining balance can be used for future orders. The balance of a gift voucher is neither paid out in cash nor interest-bearing. Gift vouchers are excluded from the application of any discounts, rebates, or promotional vouchers and can only be purchased at face value.

Redeemed gift vouchers are excluded from the right of withdrawal.

  1. RETENTION OF TITLE

NatureLeafs retains ownership of the goods until full payment has been made.

  1. WARRANTY AND GUARANTEE

a. NatureLeafs is liable for material defects in the delivered specialties according to the applicable statutory provisions, especially §§ 434 ff. of the German Civil Code (BGB).

b. For entrepreneurs, the warranty period for specialties delivered by NatureLeafs is 12 months.

c. Any additional guarantee on goods delivered by NatureLeafs exists only if expressly stated in the order confirmation for the respective specialty.

  1. LIABILITY

a. Claims for damages by the buyer are excluded. Exceptions apply to claims for damages resulting from injury to life, body, or health or from the breach of essential contractual obligations (cardinal duties), as well as liability for other damages caused by intent or gross negligence of NatureLeafs, its legal representatives, or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

b. For breaches of essential contractual obligations, NatureLeafs is liable only for the typical, foreseeable damage caused by simple negligence, unless claims for damages arise from injury to life, body, or health.

c. The above limitations of liability also apply in favor of NatureLeafs’ legal representatives and vicarious agents if claims are asserted directly against them.

d. The limitations of liability under paragraphs 1 and 2 do not apply if NatureLeafs has fraudulently concealed a defect or has assumed a guarantee for the condition of the specialty. The same applies if NatureLeafs and the buyer have agreed on the condition of the specialty.

e. The provisions of the Product Liability Act remain unaffected.

  1. ALTERNATIVE DISPUTE RESOLUTION ACCORDING TO THE CONSUMER DISPUTE RESOLUTION ACT

The European Commission provides a platform for online dispute resolution (ODR) under http://ec.europa.eu/consumers/odr/ according to Art. 14 (1) ODR Regulation.

We point out that we are not willing or obliged to participate in dispute resolution procedures before a consumer arbitration board.

  1. APPLICABLE LAW, JURISDICTION

a. The law of the Federal Republic of Germany applies, excluding conflict-of-law provisions of international private law and the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a natural person concluding the legal transaction for purposes predominantly not attributable to your commercial or self-employed professional activity, this choice of law only applies insofar as it does not deprive you of the protection granted by mandatory provisions of the state of your habitual residence.

b. If you have no general place of jurisdiction in Germany or any other EU member state, or if you are a merchant or a public law entity, or if you have moved your habitual residence abroad after these Terms came into effect, or if your residence or habitual place of abode is unknown at the time of action, exclusive jurisdiction for all disputes arising from this contract is the registered office of NatureLeafs.
